MPtHA NSF POLICY

From time to time, MPtHA will be the recipient of a non-negotiable check.  To ensure that we retain positive cash flow, Minnesota Pinto will take the following action to recover funds:

The issuer of the non-negotiable check will be mailed an official ‘Demand for Payment’, requesting payment via cash, a cashier’s check, a money order, or Paypal (adding a 3% electronic convenience fee for the Paypal option) for payment in full of the NSF check, plus a $35 fee.  Said payment must be received by Minnesota Pinto within 10 (ten days) as stated in the Demand, in order for the issuer to remain a member in good standing with Minnesota Pinto.

Should the issuer fail to reimburse MPtHA within the 10-day time frame, MPtHA will report the non-negotiable check to the Wright County Attorney’s office for resolution through the Wright County Bad Check Program.  Once this action is taken, we cannot withdraw our request from the County.  We ARE REQUIRED to report the non-negotiable check to the Pinto Horse Association business office as well.

The issuer of the bad check will then be considered NOT in good standing with MPtHA, and will be ineligible for participation in any MPtHA program until the bad check is paid in full. 

Further, the issuer will be placed on a CASH ONLY basis for 12 months following payment in full of the NSF check.  The issuer and/or any exhibitors related to this transaction will forfeit all MN Pinto points earned, and said points will not count towards Minnesota Pinto year end awards. 

Only payment in full will be accepted to rectify the NSF check.  Multiple exhibitors under one check will not be allowed to pay his or her portion only.  The effected exhibitors will receive a courtesy notification if the NSF check is not made good by the issuer within the said ten days; then, entire balance of NSF check and fees must be resolved within ten days of the courtesy notification in order for the points to remain valid.

If the NSF check is rectified within either of the 10-day period as stated above, the issuer may continue to transact business with MPtHA using checks, or any other viable method of payment.

Any individual issuing a second non-negotiable check to MPtHA will be sanctioned as determined by the Board of Directors, including, but not limited to, requiring CASH ONLY from the repeat offender.
